Delhi Police File Case Against AAP’s Amanatullah Khan for MCC Violation

Delhi Police have registered a case against Aam Aadmi Party (AAP) MLA Amanatullah Khan for allegedly violating the Model Code of Conduct (MCC) during the Delhi Assembly Elections 2025.
The case was filed at Jamia Nagar Police Station after a video surfaced online showing Khan roaming his constituency Okhla with supporters after the conclusion of the campaigning period.
The DCP South East Delhi posted on X (formerly Twitter), “In this matter, FIR No 95/25 under section 223/3/5 BNS & 126 RP Act against Amanatullah has been registered at Police Station Jamia Nagar for violating MCC.”
Legal Challenges and Criminal Cases
Amanatullah Khan is among the Delhi election candidates with the highest number of criminal cases. According to a report by the Association for Democratic Reforms (ADR), he has 19 criminal cases against him.
Delhi Chief Minister Arvind Kejriwal also has 15 cases registered against him, further adding to the legal scrutiny faced by AAP candidates.
Delhi Elections 2025: Voting and Controversies
Delhi is witnessing high-stakes elections for 70 Assembly seats, with voting scheduled from 7 AM to 6 PM. However, the campaign period has been marred by several controversies, particularly targeting AAP leaders.
Just a day before the voting, another AAP candidate, Atishi, was booked for MCC violations, sparking a major political controversy.
AAP supremo Arvind Kejriwal criticized the Election Commission of India (ECI) and the Delhi Police, accusing them of unfairly targeting his party.
Atishi’s MCC Violation Case
Delhi Police reported that AAP leader Atishi was caught roaming in her constituency with 50-70 supporters and 10 vehicles after the official campaign period ended.
The police directed her to leave the area, but a complaint was lodged by the Flying Squad Team (FST), leading to an FIR under section 223 BNS & 126 RP Act at Govindpuri Police Station.
The DCP’s official statement read: “On February 4 at 12:30 AM, AAP candidate from Kalkaji (AC-51) with 50-70 people & 10 vehicles was found at Fateh Singh Marg. Police instructed them to vacate due to Model Code of Conduct (MCC). On a complaint by FST, a case under section 223 BNS & 126 RP Act is registered.”
Kejriwal’s Response and Political Fallout
Arvind Kejriwal reacted strongly to the legal actions against AAP candidates, calling it an attempt to weaken AAP and benefit BJP.
He took to social media, accusing the Election Commission and the Delhi Police of acting unfairly and protecting BJP’s interests.
He stated, “The actions by the Election Commission of India and the Delhi Police are tantamount to supporting hooliganism against AAP and protecting the BJP’s wrongdoing.”
Other AAP Leaders Facing Legal Scrutiny
Amanatullah Khan and Atishi are not the only AAP leaders facing legal action. Other prominent party members, including Dinesh Mohaniya and Ajay Dutt, have also been booked for alleged violations:
- Dinesh Mohaniya was accused of making inappropriate gestures toward a BJP woman worker.
- Ajay Dutt’s family was allegedly involved in physically assaulting a BJP woman worker.
- Atishi’s supporters were charged with obstructing government work and allegedly assaulting a police officer.
Delhi Elections: Security and Political Climate
Security has been tightened across Delhi as election day unfolds. Authorities have classified nearly 3,000 polling booths as sensitive, deploying:
- 220 paramilitary force companies
- 35,626 Delhi Police personnel
- 19,000 Home Guards
These measures aim to ensure a smooth and peaceful voting process.
BJP and Congress React to AAP’s Allegations
Following Atishi’s criticism of the Election Commission, BJP candidate Ramesh Bidhuri dismissed her claims, alleging that AAP was resorting to panic-driven tactics due to fears of losing the elections.
BJP countered AAP’s claims, arguing that all parties are being held accountable for MCC violations.
Meanwhile, Ramesh Bidhuri’s nephew, Manish Bidhuri, was also booked under the Representation of the People Act for similar election violations.
Election Results and Future Implications
The Delhi Assembly Elections 2025 results will be declared on February 8, 2025. The battle remains intense between AAP, BJP, and Congress, as each party seeks control of the national capital’s governance.
With growing political tensions, legal battles, and MCC violations making headlines, observers are closely watching how these controversies shape voter sentiment and election outcomes.
